RESTAURANTS:
If you are opening or have a restaurant in California, you will need a California Liquor License if your intent on providing any kind of alcohol to your customers. Two of the most common types of Liquor Licenses for restaurants is Liquor License Type 41 and Type 47. The Type 41 Liquor License allows your business to sell and/or serve beer and wine. The Type 47 Liquor License allows your business to sell and/or serve beer, wine, and distilled spirits (Hard Liquor). Both licenses require you be a “bona fide eating place.” This means that your business must generate at least 51% of all gross sales from food.
CONVENIENT, GROCERY OR LIQUOR STORES:
Type 20 Liquor License: The Type 20 Liquor License is exclusively for businesses that offer off sale beer and wine only. The Type 20 Liquor License prohibits a business from selling distilled spirits (hard liquor). Type 21 Liquor License: The Type 21 Liquor License allows your business to sell beer, wine, and distilled spirits (Hard Liquor).
NIGHTCLUBS AND BARS:
For a Nightclub or Bar where patrons must be over 21 years old, you should obtain a Type 48 Liquor License. A type 48 Liquor License allows you to sell and/or serve beer, wine, and distilled spirits. No food is required.
TWO OTHER UNIQUE TYPE OF LIQUOR LICENSES:
The Type 40 Liquor License authorizes the sale of beer only for consumption on or off the premises where sold. No wine or distilled spirits may be on the premises. Full meals are not required; however, sandwiches or snacks must be available. Minors are allowed on the premises. The Type 42 Liquor License authorizes the sale of beer and wine for consumption on or off the premises where sold. No distilled spirits may be on the premises. Minors are not allowed to enter and remain (Call us to explain Section 25663.5 for exception, musicians). Food service is not required.
